text: 'Rechtspraak bestuursrecht behoort een tegenmacht te zijn, geen verlengstuk

van het bestuur. Zelfs de schijn van partijdigheid is reden voor publieke toetsing
|
||
gezien de gevolgen van de toeslagenaffaire.

||
Mijn eerste ervaring met de Raad van State dateert van 11 maart 2022 (kort geding
|
||
en bodemprocedure 202201505/1+2/A3), zitting op 7 april. De Gelderlander was
|
||
aanwezig, had alle reden om de rechter kritisch te volgen, maar publiceerde
|
||
een kritiekloos verslag. Columnist Marcel Rözer putte er zelfs moed uit voor
|
||
zijn smadelijke column van 3 juni 2022 — zonder wederhoor, zonder context.
|
||
|
||
|
||
Deze review maakt deel uit van mijn publieke archiefverzet: een lexicon van
|
||
ervaringen die de schijnneutraliteit van onze rechtsstaat documenteren
|
||
|
||
|
||
De Raad verklaarde mij niet-ontvankelijk omdat ik “150 meter te ver van het
|
||
terras woonde” en “een drukke weg ertussen lag.” Mijn mantelzorg voor mijn broer,
|
||
waarvoor ik dagelijks driemaal langs het terras liep, ook de verzorgende moest
|
||
voor zijn avondeten er langs en week daarom uit naar het snelfietspad (foto
|
||
15-8-21), werd genegeerd. Op de foto van 4-6-21 in blauw trainingspak de gedogende
|
||
uitbater, volgens eigen zeggen handhaafde hij. Niet-ontvankelijk betekent dat
|
||
er ook geen inhoudelijke toetsing nodig is, dus ook niet van het geblokkeerde
|
||
trottoir (zie foto''s) en ook niet de valse verklaring van de horeca-inspecteur.
|
||
De uitspraak was kortom geen juridische toetsing, maar een afstandelijk afweermechanisme
|
||
— alsof recht alleen geldt binnen een straal van 100 meter.
|
||
|
||
|
||
Sinds eind 2022 liggen vijf omgevingsvergunningen van Daalseweg (197, 193, 2×189,
|
||
187) bij de Raad in hoger beroep (zie foto''s) omdat rechtbank Gelderland weigerde
|
||
inhoudelijk te toetsen. In hoger beroep heb ik mijn taal aangescherpt. Op 3
|
||
april 2025 won ik mijn beroep over Daalseweg 199 — na een tweede poging. Toeval?
|
||
Nauwelijks. Mijn art. 12-procedure van 21 januari 2025, na mijn aangiftes van
|
||
3 september en 4 december 2024, had de contouren van het systeem al blootgelegd.
|
||
|
||
|
||
De Raad van State is gezien mijn ervaringen geen neutrale toetsende instantie,
|
||
de verdenking bestaat al lang maar kan hier bewezen worden. Eerder een bestuurlijk
|
||
verlengstuk dat zich achter formele criteria verschuilt om inhoudelijke toetsing
|
||
te vermijden. Wie als burger opkomt tegen gemeentelijke willekeur, wordt niet
|
||
gehoord — maar weggefilterd via afstandscriteria en procedurele schijnneutraliteit.

Ik onderschrijf de bevinding van de toeslagenaffaire, tegenkrachten ontbreken
|
||
binnen onze rechtsstaat waardoor schijnveiligheid gecreëerd wordt.

Er zitten daar mensen aan de balie van ik schat nog niet ouder dan 20 jaar,

text: 'In een gemoderniseerd pand uit 1748 in het centrum van Den Haag is de Raad

van Staten (RvS) gevestigd. Deze overheidsinstelling is voor burgers de hoogste
|
||
bestuursrechter. Als je het niet eens bent met een besluit van je gemeente,
|
||
provincie, waterschap of de overheid kan in beroep gaan bij de Afdeling bestuursrechtspraak
|
||
van de RvS. Een rechter luistert echt naar je verhaal en doet enige weken later
|
||
een uitspraak. De zitting is laagdrempelig en (als je zoals meestal verliest)
|
||
niet gratis (184,- euro in 2022).

||
In de koffiecorner is tegen betaling koffie en snacks te verkrijgen. Voor de
|
||
deur is een bushalte. Parkeren kan in de vele betaalde parkeergarages (Q-park
|
||
Maliveld is groot, makkelijk te vinden maar wel 8 minuten lopen).

Daarnaast is de RvS voor de regering een onafhankelijk adviseur over wetgeving
